California’s Weekly Average Wage Rises

The California Workers’ Compensation Institute has reported that the State Average Weekly Wage increased slightly over two percent during the 2014-15 year. This will have a significant impact on disability claims and awards in the 2016 calendar year, as it will increase weekly payments awards that are tied to the State Average Weekly Wage. California workers’ compensation claims use this number frequently, as it governs the minimum and maximum amounts that you can be awarded as a result of your injury.

How Does This Impact My Claim?

In California, any form of total disability is awarded a set dollar amount within a certain range, based primarily on your earnings from your most recent employment. Your award will then be 55 percent of the earnings you received during your highest quarter of the initial period, up to the legal maximum.

The Stave Average Weekly Wage went from $1,095.70 to $1,120.67, an increase of about 2.3 percent. For claims made in California for 2016, the maximum will rise by that same 2.3 percent level, with the maximum rising to $1,128.43 per week. This will also influence minimum award amounts for both temporary and permanent disability awards in 2016, increasing them from $165.49 to $169.26.

If you have been awarded temporary disability that is more than two years old, permanent disability, or life pension awarded before the end of 2002, your benefits could also increase by this 2.3 percent amount.
